TERMS OF SALE (For E-proshop)

1. Introduction

Welcome to Daikin e-Proshop (www.e-proshop.com.sg/) owned and operated by Daikin Airconditioning (Singapore) Pte Ltd ("we", "us" and "Daikin") and you can contact DSP via the "Contact us" page on the Website.

2. YOUR USE OF Daikin e-Proshop

Use of Daikin e-Proshop is limited to parties that can lawfully enter into and form contracts under the laws of Singapore.

You may not misuse Daikin e-Proshop.

 

You may use Daikin e-Proshop only as permitted by applicable Regulations.

You must not use Daikin e-Proshop: (i) in any way that causes, or is likely to cause, Daikin e-Proshop, or any access to it, to be interrupted, damaged or impaired in any way; (ii) for fraudulent purposes, or in connection with a criminal offence or other unlawful activity; or (iii) to cause annoyance, inconvenience or anxiety.

The licences granted by Daikin Airconditioning (Singapore) Pte Ltd under these Conditions terminate if you do not comply with these Conditions and any other Applicable Terms. We reserve the right to refuse service, terminate accounts or remove or edit content if you are in breach of applicable Regulations, these Conditions or any other Applicable Terms.

3. ELIGIBILITY AND REGISTRATION REQUIREMENTS

You may only buy Products on Daikin e-Proshop if you register for a user account

4. Your status

By placing an online order through our Daikin e-Proshop you are warranting to us that:

a) you are purchasing our product/s for your personal consumption and not for business or commercial purposes;

b) you are at least eighteen (18) years old; and

c) you are legally capable of entering into binding contracts.

d) Any information you provide to us is complete and accurate;

e) You are a resident in Singapore;

f) You are accessing our site from Singapore; and

a) We may also provide links on our site to the websites of other companies, whether affiliated with us or not. These links are provided for your convenience to provide further information. They do not signify that we endorse these other websites. We have no responsibility for the content of these other websites. We make no representations or warranties that these other websites do not infringe the intellectual property rights of any person. We are not authorizing the reproduction of material found on these other websites. You acknowledge that Daikin Airconditioning (Singapore) Pte Ltd is not responsible for the availability of, and does not endorse the content of, links to external third party websites.

b) You acknowledge that Daikin Airconditioning (Singapore) Pte Ltd is not liable for any loss or damage that you may suffer as a result of the availability of, or your access to, any external links, including as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such external links.

6. Placing on order

All Sales Orders submitted to Daikin Airconditioning (Singapore) Pte Ltd through Daikin e-Proshop are subject to our acceptance. Sales Order acceptance and the completion of the contract between you and Daikin Singapore will take place on the dispatch to you of the purchased Goods, and until that time we reserve the right to reject your Sales Order.

a) When you place an order to purchase products from us, your order is deemed an offer to purchase products from us. We have absolute discretion to reject your order without any reason. Your order is accepted when we send you an email informing you that we have accepted your order.

b) Items purchased online may not be in stock even after order confirmation. If we are unable to fulfill your order, we will contact you to offer an alternative product or advise a full refund.

c) You cannot cancel your order once we accept your order. We reserve the right to refund you the price of any product/s for which you have paid (in lieu of delivery or supply of such product/s), even after we have sent you an email informing that your order has been accepted and payment has been received by us.

d) All purchases made at Daikin e-Proshop are strictly for Domestic Delivery only.

7. Display: Pricing and Availability

a) In describing the products available to purchase online, Daikin Singapore attempts to be as accurate as possible. However, Daikin Singapore does not warrant that product descriptions, images, free gifts and prices or other content of any Daikin Singapore Services are accurate, complete, reliable, current, or error-free. Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors (including processing errors) may occur. If we discover an error in the price or payment of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If the order is cancelled and you have already paid for the goods, you will receive a full refund.

b) Where applicable, prices are inclusive of GST. Delivery costs will also be charged; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

c) The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

8. Errors on Our Site

Prices and availability of Goods are subject to change without notice. Errors will be corrected where discovered, and Daikin Singapore reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after a Sales Order has been submitted and whether or not the Sales Order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your Sales Order is cancelled, Daikin Singapore will issue a credit to your credit card account in the amount of the charge. Individual bank policies will dictate when this amount is credited to your account.

9. Payment

a) Unless otherwise stated, all payments to be made through the Daikin e-Proshop shall be made using credit card payment (where you are the cardholder of that card) or as we may from time to time allow so and shall be made in accordance with such procedures as we may from time to time specify. Please note that payment must be received in Singapore dollars. In order to facilitate the payment process, you will be transferred to a secure payment site where you can enter your credit card or debit card details. Payment for all products must be by credit card or debit card. We accept payment with most major credit and debit cards. Normal Full Payment: Mastercard & Visa Credit or Debit Cards.

Unless otherwise stated, all Prices quoted are inclusive of goods and services tax.

10. Using Promotional Codes

a) We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made through this Daikin e-Proshop.

b) Only one promotional discount code can be applied to an order.

c) Promotional discount codes reflected on digital coupons are debited at the time an order is placed.

d) Digital coupons will automatically be redeemed against purchase totals, up to the total purchase amount.

e) Digital coupons must be used prior to their noted expiration date and within a single transaction.

f) Digital coupons cannot be replaced if it is lost, stolen, deleted, or if you cancel or return your purchase.

g) Digital coupons are not exchangeable for cash and unutilised amounts will not be refunded.

h) In the event where the total purchase value is below the coupon value, the excess value of the coupon will not be refunded. Coupon will not be applicable with any other promotions that may be promoted in Daikin e-Proshop, unless otherwise stated.

i) Digital coupons will be issued with their own set of conditions and they are specific to each version of the coupon. Please refer to the specific terms that come with the usage of digital coupons.

j) The terms and conditions stated in each digital coupon shall be final and conclusive.

11. Delivery

a) Deliveries will be made only within Singapore except for restricted areas (Tuas/ Jurong Island/ Sentosa)

b) Delivery will be at the address in Singapore you have stated in your order. We will endeavor to make delivery within seven (7) days of our email informing you that we have accepted your order but the time of delivery is not the essence of the agreement. We will not be liable to you for failure to deliver due to causes beyond our control. We may at our discretion use a third party delivery contractor to make deliveries.

c) *Deliveries of items are done by proshop dealers.

12. Installation Guideline, Terms & Conditions

a)*Installations are done by proshop dealers

b) Free One time Air-con Installation is only available for Basic HDB installation of split air-cons, excluding stainless steel brackets, additional optional services, site survey etc.

13. Risk of loss and damage during delivery

There may be the risk of loss and damage of the products you purchased when passing to you on delivery. If defective, we shall retain title to the products until such time as payment in full (including delivery charges) has been affected.

14. Cancellation, Returns and Exchanges

a) All items sold are strictly non-refundable and change-of-mind exchanges are not applicable. Items with hardware mechanical defects or failures that affect product function may be exchanged within 7 days of purchase.

b)Daikin Singapore, at its sole discretion, reserves the right to evaluate or reject any exchange of item.

c) In the event of any order cancellation, the refund will exclude paid delivery charges.

No exchanges or refunds for all Daikin e-Proshop digital vouchers or any Digital Services due to the utilisation of unique passwords once sold.

 

Orders are returnable only if they are incorrect or defective. An “incorrect” item means the item delivered is not what you ordered (i.e. the model or colour is different from what is indicated on the order confirmation or there are missing items or parts inside the packaging).

If you discover any external cosmetic damage (such as scratch, dent, stain or crack) on the item, it may only be returned if you arrange the returns request on the same day as the day the item is delivered to you. Incorrect orders and items with functional defects may only be returned if you arrange the returns request within 7 days starting from the day the items are delivered to you.

Returned items must meet the following requirements:

The returns request must be submitted within 7 days (or within the same day for returns due to external cosmetic damage) from the day the item is delivered to you. You must provide proof of purchase with delivery order receipt and order/invoice number at the point of submitting your returns request.

The item must be shipped back to us via our appointed courier company (as arranged by us after you make a returns request).

Item must be in brand new condition and returned in its original packaging along with all accessories (including manuals, warranty cards, certificate of authenticity) and free gifts received with it. All packaging must be unmarked and not defaced in any manner.

Item must be returned in the original delivery box (or with, at least, suitable packaging) to protect the product from damage during return delivery.

Daikin Singapore reserves the right to reject any cancellation or refund deemed unfit or unreasonable even after the relevant Sales Order is confirmed and payment has been received by Daikin Singapore, in lieu of delivery or supply of such Goods.

15. Defective Items

If the product is defective, we will repair the product for you within 14 days from the date of purchase if it is collected in store, or the date of delivery if it is a delivered item.

If the repair is not reasonably possible or cannot be done within a reasonable period of time and without significant inconvenience to you, you may keep the defective Goods and ask for a partial refund, or return the defective Goods and ask for a full refund. Please note that the amount of the full refund will take into account the Goods’ current state resulting from your use.

On returning defective Goods, please note that any free gifts, vouchers and accessories associated with the purchase must also be returned at the same time. If free gifts, vouchers and accessories have been used, the refund amount will be offset accordingly. If delivery has taken place, then the refund will exclude delivery charges paid.

Display sets cannot be exchanged.

In accordance with the Consumer Protection (Fair Trading) Act, Daikin Singapore reserves the right to prove (or, if the breach appears more than 6 months after delivery, requires you to disprove) that the product was of satisfactory quality and otherwise complied with the terms of purchase at the time of delivery.

16. Liability

We exclude all representations, warranties, conditions and terms (whether express or implied by statute, common law or otherwise) to the fullest extent permitted by law. We will not be liable for damages which are not reasonably foreseeable arising out of or in connection with your online order through our Daikin e-Proshop.

We make no representation or warranty that any product specified in our Daikin e-Proshop will be available for purchase at any of the Daikin Proshop retail stores in Singapore at the specified price or at all.

Not all products / promotions available online are available in stores. Online products, variants, pricing and availability may vary from Daikin Proshop retail stores.

Except to the extent required by any applicable law, we will not be liable to any person for any loss or damage which may arise from the use of or reliance on any content or information displayed on our Daikin e-Proshop.

We will not be liable to you or any party for any damages, losses, expenses or costs whatsoever (including without limitation, any direct, indirect, special, incidental or consequential damages, or economic loss or loss opportunity) arising out of or in connection with your online order through our Daikin e-Proshop, or reliance on any information, materials or online services provided at our Daikin e-Proshop, regardless of the form of action and even if we had been advised as to the possibility of such damages. This exclusion clause shall take effect to the fullest extent permitted by Singapore law.

In any event, and notwithstanding anything contained in these terms & conditions, our maximum aggregate liability in contract, tort (including negligence or breach of the statutory duty) or otherwise arising out of or in connection with your online order through our Daikin e-Proshop shall be limited to the price of the products purchased from our Daikin e-Proshop.

17. Product Display/Colors

Daikin e-Proshop attempts to display product images shown on the site as accurately as possible. However, we cannot guarantee that the colour you see matches the product colour, as the display of the colour depends, in part, upon the monitor you are using. Where there are accessories or furnishings included in the product image, they are used purely for illustration purposes and will not be included in the final sale of the product.
